Today I will be taking a moment to review TAS/ADA requirements for dispersion of dining surfaces.  This is an area that comes up fairly often in Plan Reviews.  While many assume that as long as you have 5% of the seating "Accessible" you are compliant, that's often not the case.

Here is what the 2012 TAS says about dispersion of Accessible Dining Surfaces:

 


226.2 Dispersion. Dining surfaces and work surfaces required to comply with 902 shall be dispersed throughout the space or facility containing dining surfaces and work surfaces.


"Dispersed throughout" is some what vague.  This statement left a lot to interpretation. 
TDLR published Technical Memorandum 2013-14 in June of 2013.  Here is what it says about dispersion:

 


The requirements of TAS 226 and 902 are applicable to fixed or built-in dining surfaces based on TAS 201.1. In addition, dining surfaces must be dispersed based on TAS 226.2; therefore, each type of dining surface must comply with TAS 902. Examples of different types of dining surfaces include, but are not limited to, bars, tables, lunch counters, and booths.



So if you provide different types of fixed or built in seating for dining, at least one of each type will have to comply. Possibly more depending on the the number of spaces available.  In some cases, because of the requirement for one of each type, there will be more than 5%.  

The same TM also states:

 


A measurement of 18” per person shall be used to calculate the number of seating and standing capacity of a dining surface." 

Clear floor space complying with TAS 305 for a forward approach is required for an accessible dining
surface based on TAS 902.2. Therefore, accessible dining surfaces shall be 30” minimum in length
based on 305.5 or 36” minimum if the clear floor space is located in an alcove based on TAS 305.7.1.
